Terms of Service

1. Agreement to these Terms

These Terms of Service (the “Terms”) form a binding agreement between you (“you”, “your”, or “Student”) and 1001302039 Ontario Inc., an Ontario corporation carrying on business as BetterLSAT (“BetterLSAT”, “we”, “us”, or “our”).

By creating an account, taking a diagnostic, purchasing a subscription, booking a tutoring session, or otherwise using betterlsat.com, our web or mobile applications, or any related service (collectively, the “Services”), you agree to these Terms and to our Privacy Policy, which is incorporated by reference.

If you do not agree to these Terms, do not use the Services.

2. Important notice about LSAC and the LSAT

Please read this section carefully.

  • We are not LSAC. BetterLSAT is an independent test-preparation company. We are not affiliated with, endorsed by, sponsored by, or created in association with the Law School Admission Council, Inc. (“LSAC”).
  • LSAC does not review or endorse us. LSAC does not review or endorse specific test-preparation materials, companies, or services. The inclusion of licensed LSAC content within the Services does not imply LSAC’s review or endorsement of BetterLSAT.
  • LSAT® and LSAC® are registered trademarks of LSAC. We use these marks descriptively and under the limited permissions granted to us.
  • We are an official LSAT content licensee. BetterLSAT holds a content licence from LSAC permitting the use of certain Official LSAT PrepTest content within our paid offerings. That licence governs how licensed content may be used and is described in Section 10.
  • Our free diagnostics do not use LSAC content. See Section 9.

Where actual LSAT® content is reproduced within the Services, the following notice applies:

LSAC does not review or endorse specific test-preparation materials, companies, or services, and inclusion of Licensor Content within this work does not imply the review or endorsement of LSAC. LSAT (including variations) and LSAC are registered trademarks of LSAC.

3. Eligibility and accounts

3.1 Age

You must be at least 18 years of age to create an account and purchase a subscription. If you are between 13 and 17 years of age, you may use the Services only with the consent and involvement of a parent or legal guardian, who agrees to be bound by these Terms on your behalf and is responsible for all charges. The Services are not available to anyone under 13.

3.2 Account creation

You may create an account using an email address and password or through a third-party sign-in provider such as Google. You agree to provide accurate, current, and complete information and to keep it updated.

3.3 One person, one account

Accounts are personal and non-transferable. You may not share your login credentials, allow another person to access the Services through your account, or create an account on behalf of anyone other than yourself. Credential sharing is a material breach of these Terms and may result in immediate suspension without refund.

3.4 Security

You are responsible for all activity under your account. Notify us immediately at support@betterlsat.com of any unauthorized use or suspected compromise.

4. The Services

BetterLSAT may offer, in whole or in part and subject to change:

  • Free diagnostics — short assessments that produce an estimated score range, percentile estimate, question-type analysis, timing analysis, and study recommendations;
  • Course content — structured instruction in Logical Reasoning and Reading Comprehension;
  • Question bank and explanations — practice questions, drill sets, and written and video explanations;
  • Practice tests and analytics — full-length and sectional practice, performance dashboards, and score tracking;
  • Tutoring and coaching — one-to-one or group instruction, where offered; and
  • Optional LawHub Advantage subscriptions — resold on LSAC’s behalf as described in Section 8.

We may add, modify, suspend, or discontinue any part of the Services at any time. Some content is available only at certain subscription levels.

5. Score estimates, results, and no guarantee

5.1 Estimates are estimates

Diagnostic score ranges, percentile estimates, projected scores, and study recommendations are statistical estimates generated by our own models. They are not official LSAT scores, are not produced, endorsed, verified, or equated by LSAC, and are not a prediction or promise of your actual performance on the LSAT.

5.2 Shorter assessments are less precise

Estimates drawn from a small number of questions carry a wider margin of error than estimates drawn from a full-length test. We present ranges rather than single numbers for this reason.

5.3 No guaranteed outcome

We do not guarantee any score, score improvement, percentile, admission outcome, scholarship result, or other result. Your outcome depends on factors outside our control, including your preparation, aptitude, and test-day performance.

5.4 Guarantee programs

If we offer a specific written score guarantee as part of a particular program, that guarantee is governed by its own separate written terms, which prevail over this Section 5 to the extent of any conflict. No statement by any employee, tutor, or marketing material constitutes a guarantee unless set out in those separate written terms.

5.5 Not professional advice

Information about law schools, admissions, scholarships, or applications is general information only, not legal, financial, or professional admissions advice.

6. Subscriptions, fees, and billing

6.1 Plans

Paid access is offered on a subscription basis at the plans and prices displayed at the time of purchase, in the currency shown at checkout (Canadian or U.S. dollars).

6.2 Automatic renewal

Subscriptions renew automatically at the end of each billing period at the then-current rate until cancelled. By purchasing, you authorize us and our payment processor to charge your payment method on a recurring basis.

6.3 Cancellation

You may cancel at any time through your account settings or by contacting support@betterlsat.com. Cancellation takes effect at the end of the current billing period, and you retain access until that period ends. Cancelling does not generate a refund for the current period except as set out in Section 7 or as required by law.

6.4 Taxes

Prices are exclusive of applicable taxes unless stated otherwise. You are responsible for all applicable sales, use, GST/HST, and similar taxes.

6.5 Price changes

We may change prices on at least 30 days’ notice. Changes take effect at your next renewal. Continued use after the effective date constitutes acceptance.

6.6 Failed payments

If a payment fails, we may suspend access until payment is resolved and may retry the charge.

7. Refunds

7.1 First purchase

If you are dissatisfied with your first paid subscription period, you may request a full refund within 7 days of that first purchase by contacting support@betterlsat.com. This applies once per customer.

7.2 Otherwise non-refundable

Except as set out in this Section 7 or as required by law, subscription fees are non-refundable, including for partial billing periods and for periods during which you did not use the Services.

7.3 LawHub Advantage

If you purchase a LawHub Advantage or Student Subscription through us and do not activate it, you are entitled to a full refund of that subscription fee on request, and we will issue it within fifteen (15) days of your request. This applies to the LSAC subscription fee only.

7.4 Tutoring

Sessions cancelled or rescheduled with at least 24 hours’ notice may be rebooked at no charge. Sessions cancelled with less notice, or missed, are forfeited. Unused sessions in a purchased package expire 12 months after purchase.

8. LawHub Advantage (official LSAC subscriptions)

8.1 Optional

Where we offer LawHub Advantage or an equivalent LSAC Student Subscription, purchasing it through BetterLSAT is optional. Many students already hold a subscription obtained directly from LSAC; you are not required to buy a second one.

8.2 Separate charge

The LSAC subscription fee is charged as a separate line item labelled “LawHub Advantage”, distinct from BetterLSAT’s own fees.

8.3 What it provides

A Student Subscription grants a single individual access to official LSAC materials through LSAC’s Student Application for one (1) year, running from the earlier of your payment and activation. Access is provided by LSAC and governed by LSAC’s own terms.

8.4 Activation and linking

To provide instruction using official LSAC content, we must link your Student Subscription to our coaching account through LSAC’s systems. See our Privacy Policy for what this involves.

8.5 Expiry

When your Student Subscription expires, your access to official LSAC content ends, whether or not your BetterLSAT subscription continues. Renewal requires an additional Student Subscription.

9. BetterLSAT original content (including free diagnostics)

9.1 Our questions are ours

All questions, passages, stimuli, answer choices, explanations, lessons, videos, drills, score reports, analytics, taxonomies, and other materials created by BetterLSAT (collectively, “BetterLSAT Content”) are original works owned by BetterLSAT or licensed to us, and are protected by copyright and other laws.

9.2 Free diagnostics contain no LSAC content

Our free diagnostics are composed entirely of original questions written by BetterLSAT instructors. They are not official LSAT questions, are not licensed from LSAC, are not reproduced or adapted from any LSAT question, and are not reviewed or endorsed by LSAC. They are written independently to assess the same underlying reasoning and comprehension skills the LSAT measures.

9.3 Style is not affiliation

That our original questions assess comparable skills does not imply any relationship with LSAC or that our questions are equivalent to official LSAT questions.

10. Official LSAC content (paid offerings only)

Where official LSAC content (“Licensed Content”) is made available through the Services, the following applies in addition to the rest of these Terms:

10.1 Active subscription required

You may access Licensed Content only while you hold an active Student Subscription and only at that subscription’s access level.

10.2 LSAC owns it

LSAC owns all right, title, and interest in Licensed Content. Nothing in these Terms transfers any ownership or copyright interest to you.

10.3 Prohibited uses

You must not:

(a) copy, download, screenshot, screen-record, print, transmit, publish, post, distribute, sell, or otherwise reproduce or share Licensed Content;

(b) create derivative works from, modify, adapt, translate, or “clone” Licensed Content;

(c) remove, obscure, or alter any copyright or proprietary notice;

(d) submit, upload, paste, or otherwise provide Licensed Content to any artificial intelligence system, large language model, chatbot, or automated analysis tool (including ChatGPT, Claude, Gemini, or any similar service); or

(e) circumvent or attempt to circumvent any access control, security measure, or copy restriction.

10.4 Why (d) matters

Our licence with LSAC strictly prohibits the application of any form of artificial intelligence analysis to LSAC content, and breach can result in immediate termination of our licence. Violating Section 10.3(d) is a material breach of these Terms and may result in immediate termination of your account without refund, in addition to any other remedy available to us.

10.5 Access ends with the licence

If our licence with LSAC expires, terminates, or is modified, your access to Licensed Content will end, in whole or in part, without liability to us. In that event, your sole remedy is a pro-rata refund of prepaid BetterLSAT subscription fees attributable to the unexpired portion of your then-current billing period.

10.6 Candidate Agreement

LSAC requires every LSAT test taker to sign a Certifying Statement prohibiting disclosure or discussion of LSAT content. By using the Services you confirm you have read and will comply with the LSAC Candidate Agreement.

10.7 Do not disclose live test content

You must not disclose to BetterLSAT, our instructors, our staff, or other students any question, passage, or content from an LSAT you have taken. Our instructors are directed never to solicit such information. Doing so may violate your Candidate Agreement with LSAC and may result in termination of your account.

10.8 Test-day rules and misconduct

LSAC publishes rules on test-day conduct and its misconduct and irregularities process. You are responsible for reviewing them at lsac.org/lsat/about/lsat-policies and lsac.org/about/lsac-policies.

11. Licence to you, and acceptable use

11.1 Your licence

Subject to these Terms and your payment of applicable fees, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to access and use the Services and BetterLSAT Content for your own personal, non-commercial test preparation only.

11.2 You may not:

(a) copy, reproduce, republish, distribute, sell, licence, sublicence, rent, or lease any part of the Services or BetterLSAT Content;

(b) use the Services or any content to build, train, fine-tune, or evaluate any machine-learning model, dataset, or competing product;

(c) scrape, crawl, harvest, bulk-download, or use any automated means to access or extract content;

(d) reverse engineer, decompile, or attempt to derive source code;

(e) share, resell, or provide access to your account or any content to any other person;

(f) use the Services to provide tutoring, coaching, or instruction to third parties;

(g) circumvent paywalls, access controls, usage limits, or security measures;

(h) upload malware or interfere with the operation, integrity, or security of the Services;

(i) impersonate any person or misrepresent your affiliation; or

(j) use the Services for any unlawful purpose or in breach of any applicable law.

11.3 Monitoring

We may monitor account activity to detect credential sharing, automated access, and other breaches, and may suspend or terminate accounts accordingly.

12. Your data and content

12.1 Performance data

Your use of the Services generates performance data — answers, timing, accuracy, session activity, and derived analytics. Our handling of that data is described in our Privacy Policy.

12.2 Licence to improve the Services

You grant us a non-exclusive, worldwide, royalty-free licence to use, store, reproduce, and analyze your performance data to deliver the Services, generate your reports, and develop, calibrate, validate, and improve our assessments, scoring models, content, and analytics, including in aggregated or de-identified form. Aggregated and de-identified data that cannot reasonably identify you is not personal information and may be used without restriction.

12.3 Your submissions

If you submit feedback, questions, forum posts, or other material, you grant us a perpetual, irrevocable, worldwide, royalty-free licence to use it in connection with the Services. Do not submit anything confidential or anything you do not have the right to share. Never submit content from a live LSAT (see Section 10.7).

12.4 Testimonials

We will not publish your name, score, school, or likeness in marketing without your prior consent.

13. Tutoring and coaching services

Where you purchase tutoring or coaching: sessions are scheduled by agreement; cancellation, rescheduling, and expiry are governed by Section 7.4; tutors are independent instructors engaged by BetterLSAT and are not authorized to make representations or guarantees on our behalf; and sessions may be recorded only with your consent.

14. Affiliate links, partner offers, and compensation

14.1 We may be compensated

The Services may contain affiliate links, referral links, sponsored placements, or offers from third parties, including preparation materials, admissions services, tutoring partners, and financing providers. We may receive a commission, referral fee, or other compensation if you click such a link, sign up, or make a purchase. Compensation does not increase the price you pay.

14.2 No endorsement, no responsibility

Compensation does not mean we have verified, endorse, or guarantee any third-party product, service, or claim. Third-party offers are governed by that provider’s own terms and privacy policy, and your dealings with them are solely between you and them. We are not a party to those transactions and are not liable for any third party’s products, services, representations, or conduct, including any failure to deliver, refund, or honour a guarantee.

14.3 Editorial independence

Where we recommend or rank third-party products or services, compensation may exist but is not the sole basis for inclusion. Where a placement is paid, we identify it as sponsored, an advertisement, or a partner offer.

14.4 Marketing partners

Where you opt in to receive information from a marketing or referral partner, we may share limited contact information with that partner and may be compensated for doing so, as described in our Privacy Policy. You may withdraw at any time by contacting support@betterlsat.com.

14.5 LawHub Advantage is not an affiliate arrangement

Our resale of official LSAC Student Subscriptions under Section 8 is a licensed resale charged as a separate line item, not a commission-based referral.

15. Third-party services

The Services rely on third parties including payment processors, authentication providers, hosting, analytics, communications tools, and LSAC’s Student Application. Your use of a third-party service may be subject to that party’s own terms and privacy policy. We are not responsible for third-party services or content.

16. Suspension and termination

16.1 By you

Cancel at any time under Section 6.3.

16.2 By us

We may suspend or terminate your account immediately, without refund, if you breach these Terms — in particular Sections 3.3, 10.3, 10.7, or 11.2 — or if we reasonably believe your conduct threatens the security or integrity of the Services, our relationship with LSAC, or the rights of others.

16.3 Effect

On termination, your right to access the Services and all content ends immediately. Sections 9, 10.2–10.4, 12.2, 14.2, 17, 18, 19, and 21 survive.

17. Disclaimers

THE SERVICES AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTY ARISING FROM COURSE OF DEALING OR TRADE.

We do not warrant that the Services will be uninterrupted, timely, secure, or error-free; that content is accurate, complete, or current; or that any score, improvement, admission, or scholarship outcome will be achieved.

Some jurisdictions do not allow the exclusion of certain warranties. Where the Consumer Protection Act, 2002 (Ontario) or other applicable consumer-protection legislation grants you rights that cannot be waived, nothing in these Terms limits those rights.

18. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BETTERLSAT AND ITS DIRECTORS, OFFICERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, EDUCATIONAL OR PROFESSIONAL OPPORTUNITY, SCHOLARSHIP, OR ADMISSION, ARISING OUT OF OR RELATING TO THE SERVICES, REGARDLESS OF THE THEORY OF LIABILITY AND EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO US IN THE SIX (6) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, AND (B) ONE HUNDRED DOLLARS ($100).

19. Indemnity

You agree to indemnify and hold harmless BetterLSAT and its directors, officers, employees, contractors, and agents from any claims, damages, liabilities, penalties, and expenses (including reasonable legal fees) arising from your use of the Services, your breach of these Terms, your breach of the LSAC Candidate Agreement, or your violation of any law or third-party right.

20. Changes to these Terms

We may amend these Terms from time to time. Material changes will be notified by email or in-product notice at least 30 days before taking effect. Continued use after the effective date constitutes acceptance. The “Last updated” date above reflects the current version.

21. Governing law and disputes

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-laws principles. You and BetterLSAT submit to the exclusive jurisdiction of the courts of Ontario, subject to any non-waivable right you have to bring a claim in your place of residence.

22. General

22.1 Entire agreement

These Terms, the Privacy Policy, and any program-specific terms form the entire agreement between you and BetterLSAT regarding the Services.

22.2 Severability

If any provision is held invalid, the remainder continues in full force.

22.3 No waiver

Our failure to enforce any provision is not a waiver.

22.4 Assignment

You may not assign these Terms. We may assign them in connection with a merger, acquisition, or sale of assets.

22.5 Force majeure

Neither party is liable for delays or failures caused by events beyond its reasonable control.
